GENERAL TERMS AND CONDITIONS
Based on the rights of consumers and users set out in the Royal Legislative Decree 1/2007 of 16 November, the General Terms and Conditions of Contract for this online shop are established and communicated.
Products
ASM Artists, Sports, Media & Touristik.S.L., hereinafter referred to as Gulf Motion, is the licensee of Gulf Motion’s product line of electric mobility products: e-bikes, e-scooters, and safety accessories. Gulf Motion has agreements with manufacturers, distributors, and physical shops to sell these products.
Warranty
All products come with a legal warranty for any lack of conformity that appears within 3 years from the date of delivery, in accordance with applicable regulations. The warranty does not cover deficiencies caused by negligence, misuse, improper handling, unsuitable voltage, electrical accidents, improper installation or use not in accordance with the instructions, or services not performed by authorized technicians. It also excludes perishable materials, normal wear and tear, and consumables. Products modified or repaired by the end user or any unauthorized person are also excluded from the warranty.

The End User or Customer cannot claim the product warranty and the warranty will not apply if:

a) Any details on the product warranty or proof of purchase are altered or replaced.

b) The identification number of the product is tampered with or repaired without authorization.

c) Proof of purchase and delivery note are missing.

To use the warranty, it is essential to keep the proof of purchase and delivery note. If the manufacturer offers additional warranties, the corresponding warranty certificate must be kept.

End users must follow the brand’s instructions for correct use and installation. If this information is missing at the time of purchase, the user should refer to the brand's website.

Customers may exercise the product warranty according to current consumer product warranty regulations. To do so, the product must be sent to the specified address for defect validation. The customer is responsible for shipping costs to our facilities. If the warranty is covered, we will send the repaired or replaced product at no cost to the customer. If the warranty is not covered, the customer must pay return shipping costs and any labor costs.

In any case, the manufacturer’s warranty terms will prevail.

For electric bicycle products: MONDRAKER warrants its products against defects in workmanship and materials. This warranty applies exclusively to online purchases and covers the frame or components manufactured by MONDRAKER, provided the product is not modified or equipped with unauthorized accessories. For consumers, the warranty is regulated by Royal Decree 1/2007, and amended by Royal Decree-Law 7/2021, in accordance with EU Directive 2019/771. MONDRAKER is liable for any non-conformity existing at the time of delivery and manifesting within three years from the date of delivery.

MONDRAKER’s warranty covers manufacturing defects but not misuse, improper maintenance, or incidents beyond the manufacturer’s control. Unauthorized modifications void the warranty. If consumer protection laws assume non-conformity at delivery, it will be assessed based on the product’s nature and the non-conformity.

MONDRAKER commits to providing spare parts for ten years from the date the product is discontinued. Shipping and labor costs for warranty claims are borne by the user.
SHIPPING
Shipping costs for Gulf Motion purchases are included in the product price. External companies handle transport. For e-bike purchases, home delivery is available. The delivery period is specified by MONDRAKER, and Gulf Motion will confirm delivery details via email. Exact delivery times cannot be determined. No deliveries on weekends or public holidays, but orders are processed. If you have not received your order within seven days, contact us via email to check the status. If the transport company claims delivery but you have not received it, contact us. We will also investigate from our end. Gulf Motion does not ship to the Balearic Islands, Canary Islands, Ceuta, or Melilla.
Payment Methods
We offer two payment methods:

Credit or debit card through CAJAMAR bank’s online payment gateways.

PayPal, which allows you to pay, send money, and accept payments without continuously entering your financial details. PayPal is used by 250 million people in over 200 countries. More information at PayPal.

All platforms use 3DSecure systems for 100% secure and fraud-protected payments. Gulf Motion does not store your credit card or PayPal information.
Returns and Refunds
Gulf Motion adheres to the manufacturers' return and exchange policies. Users have the right to withdraw from a purchase within 30 calendar days without justification.

For e-bike products, returns will be accepted only for products in perfect condition and in compliance with the return policy. Gulf Motion will provide a return label for the user to send the product back to the authorized point, with return costs borne by the user. The product must be in the same condition as delivered, without any use. Altered products are not accepted.

We are legally obligated to refund the cost of your product within 14 days after receiving it. The product must be returned in its original condition and packaging, including accessories and manuals.

Once you notify us of your intention to withdraw and receive our confirmation, you have seven calendar days to send the product. After this period, withdrawal is not permitted. Pack the product securely and send it with acknowledgment of receipt if possible. The estimated processing time for refunds is seven days, depending on your payment method and bank.

Order Cancellation
To cancel an order, notify us through the contact channels in our online shop. If the product has not yet shipped, we will cancel the order and refund the payment. If the product has shipped, it will be treated as a return.
Jurisdiction and Applicable Law
These General Terms and Conditions are governed by Spanish law. Any disputes regarding interpretation, compliance, or execution of these terms shall be subject to the jurisdiction of the competent courts in Madrid, with both parties waiving any other jurisdiction.
Security and Buyer Protection
We comply with SSL protocols and use the 3DSecure system in payment gateways, redirecting data to secure servers without accessing or storing it.
